1. Information We Collect
1.1 Information You Provide Directly
We collect information you voluntarily provide when you fill out a form, request information, create an account, subscribe to messages, or otherwise interact with the Service. This may include:
- Identifiers such as your full name, email address, postal address, and mobile phone number;
- Account credentials when you register for the SaaS platform (username, hashed password);
- Communications you send to us, including form submissions, chat messages, SMS replies, and emails;
- General demographic information you choose to share (e.g., the state in which you are seeking services); and
- Billing information for paying customers of the SaaS platform, which is processed by our PCI-compliant payment processors (we do not store full card numbers on our systems).
1.2 Information Collected Automatically
When you visit the Website, we and our analytics providers automatically collect limited technical information such as IP address, browser type, device type, operating system, referring/exit pages, pages viewed, and timestamps. This information is collected through cookies, pixels, and similar technologies and is used to operate, secure, and improve the Website.
1.3 Information from Third Parties
We may receive limited information from advertising networks, analytics partners, and conversion-tracking services that help us measure the effectiveness of our marketing. We do not purchase mobile phone numbers or SMS opt-in lists from third parties.
2. SMS and MMS Messaging — How We Use Your Mobile Number
This section describes how Recovery Beacon handles mobile phone numbers and message content for our SMS/MMS messaging program, including A2P 10DLC messaging campaigns we send through our messaging service provider, Telnyx LLC.
2.1 Opt-In and Consent
You will only receive SMS or MMS messages from Recovery Beacon after you have provided express written consent by one of the following means: (a) submitting a web form on https://recoverybeacon.net or an approved landing page that clearly discloses the messaging program and includes a checkbox or equivalent affirmative action; (b) texting a designated keyword to our short code or 10DLC long code; or (c) verbally confirming consent during a recorded interaction. Consent to receive messages is not a condition of purchase of any goods or services.
2.2 Program Purpose and Message Types
Messages sent through our program may include account notifications, appointment or intake reminders, follow-up communications, resource links, informational content related to recovery and mental wellness, and, where applicable, promotional information about Recovery Beacon services. Messages may include MMS content such as images, logos, infographics, brochures, or other visual materials that we believe will help you understand the resources available to you.
2.3 Message Frequency, Cost, and Carriers
Message frequency varies depending on your interactions with us. Message and data rates may apply based on your wireless carrier plan. Recovery Beacon and its messaging provider are not liable for delayed or undelivered messages. The program is available on most major U.S. carriers; carriers are not liable for delayed or undelivered messages.
2.4 Opt-Out and Help
You may opt out of receiving SMS/MMS messages at any time by replying STOP to any message you receive from us. You will receive a single confirmation message and no further messages will be sent unless you re-enroll. For help, reply HELP to any message or contact us at the address listed in Section 12. You may also contact us by email or phone to be removed from the messaging program.
2.5 No Sale or Sharing of Mobile Information — 10DLC Disclosure
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories of information described in this Privacy Policy exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties.
We share mobile phone numbers and message content only with the subprocessors strictly necessary to deliver, route, secure, and audit the messages you have requested. These subprocessors currently include Telnyx LLC (our A2P 10DLC messaging carrier) and the underlying mobile network operators that deliver the message to your device. These parties are contractually prohibited from using your mobile information for their own marketing or promotional purposes.
2.6 Data Retention and Storage of Message Data
Recovery Beacon practices data minimization with respect to SMS/MMS data:
- We do not store the full content of inbound or outbound message bodies any longer than is reasonably necessary to deliver the message, audit deliverability, and comply with carrier and regulatory requirements.
- Message content used solely for transactional delivery is purged from our active systems on a rolling basis, typically within 30 days, except where a longer retention period is required to demonstrate consent, respond to a carrier audit, defend against a legal claim, or comply with applicable law (e.g., TCPA, CTIA, and carrier guidelines, which generally recommend retaining proof of consent for at least four (4) years).
- MMS image content sent through our campaigns is generated from approved creative templates; we do not retain user-supplied images sent to us via MMS beyond what is required to respond to your inquiry, after which such images are deleted.
- Mobile phone numbers and opt-in records are retained for as long as you remain opted-in, plus the statutory periods described above after opt-out.
- We do not sell or rent your mobile phone number, your message history, or your opt-in record to any third party for any purpose.
3. How We Use Information
We use the information we collect to:
- Operate, maintain, secure, and improve the Website and the SaaS platform;
- Provide the products, services, content, and information you request, including SMS/MMS messages you have opted into;
- Respond to inquiries, deliver customer support, and follow up on requests for information;
- Send transactional communications such as account notices, security alerts, and service updates;
- Personalize your experience and measure the effectiveness of our marketing efforts;
- Detect, prevent, and address fraud, abuse, security incidents, and violations of our Terms and Conditions; and
- Comply with our legal obligations, including obligations under the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, CTIA Messaging Principles and Best Practices, and applicable state laws.
6. Children’s Privacy
The Service is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without verified parental consent, we will delete that information promptly. SMS/MMS messaging is intended for users 18 years of age or older.
7. Your Rights and Choices
Depending on where you reside, you may have certain rights with respect to your personal information, including the right to access, correct, delete, or port your information, and the right to opt out of certain uses. To exercise these rights, contact us using the information in Section 12. You will not be discriminated against for exercising your rights.
California residents have additional rights under the California Consumer Privacy Act (CCPA/CPRA), including the right to know what categories of personal information we collect, the right to delete personal information, and the right to opt out of “sales” or “sharing” of personal information (we do not sell or share personal information as those terms are defined under the CCPA).
8. Data Security
We implement reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. These measures include encryption in transit (TLS), access controls, role-based authorization, secure data centers, and regular security review. No method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.
9. Third-Party Links and Services
The Service may contain links to third-party websites, products, or services. We are not responsible for the privacy practices or content of those third parties. We encourage you to review the privacy policies of any third-party site you visit.
10. International Users
The Service is operated from the United States and is intended for users located in the United States. If you access the Service from outside the United States, you consent to the transfer of your information to, and processing of your information in, the United States.
11. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Effective Date” at the top of this page. Material changes will be communicated through reasonable means, which may include posting a notice on the Website or sending a message to active subscribers. Your continued use of the Service after the effective date of any update constitutes acceptance of the revised Privacy Policy.
